GuidetothePhilippines, Inc. and its affiliates (also collectively referred as “Company”, “we,” “our,” and “us”) established this Data Privacy Policy to show that we recognize and value your privacy rights.

Applicability

This Data Privacy Policy applies to Personal Information we collect on the websites, applications, and points of contact listed below (collectively, the "Sites"):

We have prepared this Privacy Policy to help you understand how GuidetothePhilippines collects, uses and seeks to safeguard the Personal Information (as defined below) you provide to us on our websites, via email, and through our service providers and distribution partners. This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third party, including any third-party distribution partners, suppliers and tour operators, and any third party operating any site to which our websites contain a link. By downloading, accessing or using our websites, or providing information to us in connection with our websites, you agree to the terms and conditions of this Privacy Policy.

Processing of Information by Third Party and Links to Other Websites

This Data Privacy Policy shall not apply to third party service providers and to other websites which have white label link to our Sites. The processing of your Personal Information in the third party’s Sites is subject to their respective Data Privacy Policy. In no event will the Company be responsible for the information these third parties will collect and process, neither will the Company be liable for any loss, damage or injury arising out of or in connection with the use of or reliance on such third party. 

Personal Information We Collect

Personal Information” is information that identifies you as an individual which could also be considered “sensitive personal information”, such as but not limited to the following:

  • Name
  • Age
  • Date of Birth
  • Gender
  • Contact Details [Address, Telephone number (including home and mobile phone numbers), Email address]
  • Nationality
  • Country of Residence
  • Passport Details
  • Frequent Flyer Number
  • Details related to your flights and other travel details, including your preferences and travel behavior
  • Your dietary requirements and health issues or medical information which you voluntary provide to us in connection with your use of our products and services
  • Facebook information (Facebook email address, Facebook username)
  • And such other additional information that will be required in relation with herein declared purpose and use of information

If the Personal Information was provided by a minor or one who is not legally capable of entering into contractual transactions without parental or guardian consent, the parent or guardian shall be responsible in giving the consent required under this Data Privacy Policy and in correcting any information given or in informing us that the information should be disregarded or deleted.

If you provide us or our service providers with Personal Information of other people in connection with the services we offer, you hereby represent that you have the authority to do so and have secured consent to permit us to use the information in accordance with this Data Privacy Policy.

When you visit guidetothephilippines.ph or any of our affiliates' web pages that are hosted by us, our web server automatically recognizes and collects your IP address, which is assigned by your Internet Service Provider and does not identify you personally.

We also use cookies (as discussed below) to collect information about the performance and usability of our websites.

Cookies

"Cookies" are pieces of information that are stored by your web browser on your computer's hard disk, for record-keeping purposes. Cookies in and of themselves only identify your computer; they do not personally identify you.

First-Party Cookies: At GuidetothePhilippines we make use of cookies to store your preferences, record session information, collect information on how you visit and access our websites, and to tailor our web pages to your needs. We also use cookies to analyze and measure the effectiveness of our email communications, website features and offerings, and advertisements, and track the commissions we earn from other websites.

Third-Party Cookies: We also use third-party advertising companies to serve ads while you are visiting our websites and we permit these companies to place and access their own cookies on your computer in the course of serving advertisements. Such advertisers do not have access to the information we collect through GuidetothePhilippines cookies. Other companies' use of their cookies is subject to their own privacy policies and not ours.

How We Use and Protect Your Personal Information

We use your personal information for the following purposes:

  • To process your booking and other incidental request;
  • To contact you about your booking, travel, and other arrangements;
  • To process your payment and/or refund;
  • To personalize your travel experience or provide services tailored to your requirements;
  • To provide you with the information you request about our products;
  • To send you email marketing messages and information;
  • To fulfill your bookings;
  • To confirm your purchases; 
  • To ensure you are correctly billed;
  • To measure and track demographic details about our customers;
  • To target content on our website to more closely match your interests;
  • To target the appropriate content for email marketing messages to better match your interests;
  • To conduct marketing activities including sending out of email and SMS, for our products and services, or products and services of third parties, and to conduct market and other historical and scientific research to improve our products, services and marketing activities and generating consumer insights which may include combining personal information from third parties or public sources;
  • To maintain records and comply with our legal obligations;
  • For customer support; and
  • For all other purposes necessary for the provision of travel and other incidental services pursuant to your transaction. 

We will provide you with choices regarding the use and disclosure of your Personal Information for marketing purposes.

If you connect to GuidetothePhilippines using Facebook, we may show you reviews, photos and tours that your Facebook friends have posted, shared, saved or purchased on Guide to Iceland. Note that if you have Facebook friends who are using Guide to the Philippines, they may also share information about you with us through Facebook. If you wish to prevent that sharing, please review your Facebook privacy settings.

You can also choose to access third-party social media websites and services through GuidetothePhilippines (such as Facebook and Twitter). When you do so, you are sharing information with those sites, and the information you share is governed by their privacy policies.

To Whom Do We Share Your Personal Information

Some of the Personal Information we collect is shared with our service partners (e.g., tour operators) who are directly involved in fulfilling the purchases you have made from us. We only provide our service providers with your name and your local contact details, if you provide them (e.g., your hotel name for pick-ups and drop-offs, your local phone number, your mobile phone number, etc.) We do not provide our service providers with any other Personal Information. If you decide to provide any Personal Information directly to a service provider, we recommend that you review the service provider's privacy policy to determine how such service provider may use or disclose your Personal Information.

We also share your Personal Information with third parties contracted to provide us with marketing and data reporting services who are bound by an obligation of confidentiality and with other third-party marketing partners.

We currently contract with several third-party online partners to help manage and optimize our Internet business and communications. We use the services of third-party marketing companies to help us measure the effectiveness of our advertising and how visitors use our website. To do this, we use web beacons and cookies provided by such marketing companies in connection with our websites. The information we collect helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kinds of offers our customers like to see.

We may also use or disclose Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; or (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may use and disclose Other Information for any purpose.

In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information, as long as it is so combined.

Email Communications

We may send to you marketing emails with information about GuidetothePhilippines deals, destination and product news, sweepstakes, programs, etc., and other special promotions that we believe that you will find valuable, interesting or informative. We will provide you with choices regarding our use of your Personal Information for marketing purposes. If you are no longer interested in receiving future email marketing communications from GuidetothePhilippines, you have several choices for opting out of future mailings:

  • You may unsubscribe at any time by following the directions and link included in each email marketing message we send.
  • You may email content@guidetothephilippines.ph and request to be unsubscribed by including your name, email address, and the words "unsubscribe" in the subject or message body.

Please note that, even if you opt out of receiving future marketing communications from Guide to the Philippines, we will continue to send to you emails regarding your purchases and bookings, and regarding administrative information such as changes to our terms, conditions, and policies. If you make a booking or purchase at one of our websites, we may also send you information about new products, or ask your opinion about our websites, etc., so that we may improve our service to you and other consumers.

Our Distribution Partners and Suppliers

Our products are made available through our third-party distribution partners and suppliers. Our distribution partners and suppliers may have privacy policies that differ from GuidetothePhilippines’ Privacy Policy.

You should also be aware that some product or tour suppliers and some of our distribution partners may need additional Personal or Other Information (such as health or physical fitness information) to determine whether you can participate in an activity. You should read and rely upon the relevant supplier's or partner's Privacy Policy only (and not GuidetothePhilippines’ Privacy Policy), if GuidetothePhilippines does not collect this information from you directly.

Security and Storage Measures

We have established appropriate physical, technical, and organizational security measures to protect the Personal Information provided to us. We use several security techniques including secure servers, firewalls and encryption in safeguarding the storage of data. Personal Information is encrypted as it travels over the internet because we use a Security Sockets Layer (SSL) protocol. These safeguards are regularly reviewed to protect against unauthorized access, disclosure and improper use of your information, and to maintain the accuracy and integrity of the data. We will adapt and implement the necessary changes for security measures to ensure continuous security of your Personal Information.

Rights of Data Subject

The Personal Information you have provided in the Sites shall be retained for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements with third parties. You may exercise your particular Right to Access, Modify and Delete the Personal Information and change marketing preferences, by contacting us through the information provided below:

Changes to Our Privacy Policy

In the Company’s discretion, we may amend, interpret, modify or withdraw any portion of this Data Privacy Policy at any time by posting updated contents on the relevant Site, and your continued use of our Sites and services constitutes your consent to those changes.

Terms of Service 

I. Cancellation Policy

 

Cancellations of Day Tours, Combo Deals and Multi-Day tours from independent operators

Day Tours and transportation booked through the Guide to the Philippines website serviced by independent operators can be canceled up to 24 hours before departure of the tour for a full refund. This can be done via the ‘Edit Booking’ button in your electronic voucher e-mail.

In case of partial cancellations, e.g. a tour or activity portion of a multi-day tour is canceled by the operator, or a tour itinerary is changed due to weather conditions or other unforeseen circumstances, a partial refund is due. If an activity is changed, the price difference between activities will be refunded, or a percentage stated by the tour operator as the standard refund due to changes in the program of the tour.

All tours regardless of operator, which lasts for two days or more (Multi-Day Tours) may be canceled not less than seven (7) days before the tour departure date notice for an 85% refund per customer. The 15% service fee is to cover the operator cost of planning and arrangement. Please note that changing the number of people in a booking to a smaller number is considered cancellation and can in some instances result in the average price per person increasing. You are not entitled to a refund if tours are canceled less than 7 days before the departure notice.

 

Cancellations due to weather conditions

If your tour is canceled by the tour provider due to weather conditions or any other environmental circumstances, you will receive a full refund.

In cases of acts of God, fortuitous events, or any conditions beyond our control in the Philippines which prevents you to continue your travel in the Philippines, you will also receive a full refund on all products booked on Guide to the Philippines.

 

Cancellation of Multi-day tours arranged by Guide to the Philippines

You can cancel your Multi-day tours arranged by Guide to the Philippines up to 7 days before departure and receive an 85% refund. The 15% service fee is to cover our cost of planning and arrangement. No refund is issued if there are less than 7 days to the starting date of the Holiday package.

If a cancellation is made less than 24 hours after booking, Guide to the Philippines will refund the tour fully, unless the non-refundable separate booking has been made for said multi-day tours. In such cases, an amount to cover said booking will be held, while the remaining amount will be refunded.

It is not possible to cancel or alter any individual services within a package within 7 days of a multi-day tour starting date. Please note that this includes reducing the number of participants within a package.

In cases where a multi-day tour is disrupted due to official road closure or Act of God, Guide to the Philippines will reroute and or rearrange to the best of their abilities and assist with cancellations, making partial refunds when applicable and full refunds when applicable.

Clients who have purchased a Cancellation Insurance to accompany their multi-day tour can request a full refund up to 48 hours before arrival.

 

How to cancel or change a booking

All cancellations and changes must be made through the voucher that you receive on your email after booking. It will have an edit booking button that allows you to modify and cancel your bookings. After clicking the button you will be taken to a modification page where you can amend your booking details. There will be buttons available both to confirm changes and to cancel your booking. If you can not cancel or modify your booking then the time to do so has expired.

Refund of delivered services needs to be submitted within 15 days after the completion of the tour/package services. All refund requests must be made through email to operations@guidetothephilippines.ph with the email subject as: Refund Request - [Order number].

We do not charge anything for helping you change or make simple rearrangements to your booking for day tours, multi-day tours serviced by independent operators, but costs can change accordingly with your new details. Please be advised that though we always try our best, due to high demand and low availability, rearrangements are not always possible.

For multi-day tours arranged by Guide to the Philippines, please contact your travel planner (your contact at GTTP) for any changes needed. We do not charge anything for helping you change or make simple rearrangements to your multi-day tours, but please note that costs can change accordingly, depending on hotel rates, car rentals, change of included products, etc. In that case, we will either notify you about the increased costs or refund you the difference. In cases where changes reach a form that requires rebookings and tailoring of travel, a service fee of 15% of total tour price might apply.

Please note that reducing the number of people in a booking is considered a cancellation.

 

II. Pickups

During the booking process, you will be able to choose a pickup location and starting time. If you do not show up for the scheduled pickup time and location stated on your booking, your reservation is non-refundable and GTTP will not be held liable.

If you do not know your pickup location at the time of booking, you can choose to update your pickup location later, up to 24  hours before the tour departure. Click on the link in your voucher email to update your pickup location and other details. Please call the number listed on your voucher if you do not receive a confirmation of your pickup location update.

 

III. Terms of payment

When you reserve online, full payment is charged to your credit card. To reserve for group bookings and packages of more than 10 people, you can also contact us by email and make a 25% down payment. We will then start reserving your trip to secure you the best price. Full payment must be made at least thirty (30) days before your arrival. Please contact operations@guidetothephilippines.ph for this service.

All charges are made in Philippines Peso. On our website, you can view an estimate of prices in a number of currencies. This is only to help you understand the approximate price in your preferred currency. Final payment is always conducted in PHP. We also refund in PHP. As Guide to the Philippines does not charge any booking or transaction fees we can not be held liable to any loss in currency exchange during transactions, nor any third party transaction fees that may occur at the time of payment and/or refund.

 

IV. General Terms

Guide to the Philippines cannot be liable to any loss, damage, accidents, injuries, death or sickness during your tour. The same applies for any changes in tour schedule due to weather, strikes or any other force majeure. Tour operators reserve the right to change routes, schedules and itineraries if needed because of weather, road conditions or should the necessity arise because of unforeseen reasons or circumstances.

We advise all travelers to purchase a comprehensive travel insurance to minimize possible losses due to unforeseeable situations during your travel. Guide to Iceland does not offer any travel insurance, so please contact your preferred private travel insurance company.
